What Is Reckless Driving?
Under U.C.A. § 41-6a-528, a person commits reckless driving by operating a vehicle with a “willful or wanton disregard” for the safety of persons or property. This includes:
- Traveling on a highway at a speed of 105 MPH or greater, and
- Committing three or more moving traffic offenses in a sequence of acts taking place within a continuous driving period covering a total distance of 3 miles or less.
Reckless driving can take various forms. Below are some common actions that may lead to charges:
- Excessive speeding
- Driving under the influence
- Speeding up to run a red light
- Refusing to stop at a stop sign
- Ignoring a police officer’s directives to pull over
- Driving too fast for safety in poor weather conditions
